Definitions
The following words have the following meanings:
Access PIN means the 4-digit Access PIN printed on the back of the eGift Card.
Audi Australia means Volkswagen Group Australia Pty Ltd (ABN 14 093 117 876) trading as Audi Australia of Level 7, 895 South Dowling Street, Zetland NSW 2017, Australia.
Audi Store means the online Audi Store located at https://store.audi.com.au/ at which each of the eGift Cards can be used to purchase goods.
Australian Consumer Law means Schedule 2 of the Competition and Consumer Act 2010 (Cth) and any equivalent State or Territory legislation.
Card Number means the identification number that appears on the eGift Card.
eGift Cards means any electronic gift card issued by Audi Australia that you have purchased or received through the Website for the Audi Store.
eGift Card means any plastic gift card or eGift Card issued by Audi Australia that you have purchased or received for the Audi Store.
Personal Information includes, but is not limited to, your name, your email address and payment details.
Remaining Card Value means, at any time, that balance of the initial value loaded onto the eGift Card which is unspent.
Terms means these eGift Card Terms and Conditions.
Website means www.audi.com.au/au or https://store.audi.com.au/ or at such other address should the URL change.
A reference to we, us or our is a reference to Audi Australia.
A reference to you or your is a reference to the person who purchases a eGift Card, is in possession of the eGift Card at the relevant time for the purposes of these Terms, or who authorises another person to do something with or to the eGift Card on their behalf.
Introduction
These Terms govern your use of the eGift Card. We recommend that you read these Terms carefully before using the eGift Card.
Agreeing to these Terms
These Terms govern your purchase and use of a eGift Card. By purchasing, using or attempting to use a eGift Card, or by making a transaction enquiry or exercising any right to redeem any value loaded on a eGift Card, you:
- Agree to be bound by these Terms;
- Warrant to us that you will comply with these Terms and all applicable laws and that the eGift Card will not be used in any manner that is unlawful, misleading, deceptive, unfair or otherwise harmful to consumers; and
- Acknowledge that you have read and understood our Privacy Policy at https://www.audi.com.au/au/web/en.html#layer=/au/web/en/privacy-policy.html.
If you are taken to be a Consumer for the purposes of the Australian Consumer Law, these Terms are subject to the provisions of the Australian Consumer Law which cannot be excluded, restricted or modified.
It is a condition of purchase that eGift Cards must not be purchased for unauthorised re-sale by third parties. If a eGift Card is used in breach of this condition, it may, at our sole discretion and subject to the Australian Consumer Law, be cancelled without refund.
Activation
There may be a delay with the eGift Card activating in the system once loaded. During this delay, the eGift Card cannot be used for purchases or transaction enquiries.
Access PIN
You acknowledge that the eGift Card may be used to purchase goods from the Audi Store by anyone who enters a valid Card Number and Access PIN. Your Access PIN is simply our way of identifying you. It does not offer you any protection or security if your eGift Card is lost or stolen. Remember to treat your eGift Card like cash.
You are solely responsible for any loss caused by use of your eGift Card and Access PIN by you or any other person, including any use not approved or contemplated by you.
You must notify us immediately if you know or suspect any unauthorised use of your eGift Card.
Purchases with your eGift Card
eGift Cards may only be redeemed for goods available from the Audi Store.
No change will be given. Any Remaining Card Value can only be used in whole or part against future purchases from the Audi Store.
You agree that we can reduce the Remaining Card Value by the value of all purchases of goods that are authorised by you.
Purchases exceeding the eGift Card value
Your eGift Card may only be used to make purchases up to the Remaining Card Value. If you wish to make a purchase for an amount that exceeds the Remaining Card Value, you must pay the excess using another payment method.
No cash advances
You cannot obtain any cash advance with your eGift Card or redeem your eGift Card for cash.
Validity and expiry of eGift Cards
eGift Cards are valid for a period of three years from the date of issue, irrespective of the expiry date shown on the eGift Card. After a eGift Card has expired, any Remaining Card Value that remains on a eGift Card will not be available for use and no refund will be provided.
Lost or stolen eGift Cards
Treat your eGift Card like cash. Lost or stolen eGift Cards will not be replaced or refunded.
Faulty or damaged eGift Cards
A eGift Card will only be reissued if it is proven to be faulty or damaged as a result of the production process or otherwise due to the fault of Audi Australia, its agents or contractors.
Destruction of eGift Card with no value
Once the Remaining Card Value is completely used, destroy the eGift Card by cutting it in half diagonally. Your eGift Card cannot be reloaded.
Can I exchange my eGift Card?
You cannot exchange or redeem your eGift Card for cash.
Can I cancel my eGift Card?
No, you cannot cancel your eGift Card.
Checking your eGift Card balance and transaction history
You can check the Remaining Card Value, Expiry Date and transaction history at any time by contacting Audi Store 1800 319 272.
Exchanging items purchased with a eGift Card
Goods that are purchased solely, or in part, with an eGift Card may be exchanged or returned subject to the Audi Store Terms of Use and the Audi Store returns policy which are available online at https://store.audi.com.au/pages/terms-of-use and https://store.audi.com.au/pages/returns, respectively.
Your eGift Card, your responsibility
You are responsible for the use and safety of your eGift Card. You are liable for all transactions on your eGift Card, except to the extent to which there has been fraud or negligence by us or by any of our employees.
Changes to Terms
We may amend these Terms at any time. If any amendments are made to these Terms, we will publish them at https://store.audi.com.au/pages/egift-card-terms-and-conditions prior to or on the date the amendment will take effect.
Privacy
You consent to us collecting, storing, handling and using your personal information to issue the eGift Card, for the purpose of direct marketing about our products and services and any other purposes set out in our Privacy Policy. We may disclose your information to relevant third parties including Audi AG (located in Germany) and our related entities, service providers, our business partners and as required by law. We are committed to protecting your personal information and agree to handle it in accordance with our Privacy Policy, which is available online at www.audi.com.au/au/web/en.html#layer=/au/web/en/privacy-policy.html.
Force majeure
To the extent permitted by law, we will not be liable to you for any loss or damage (whether direct or consequential), nor be in default under these Terms, for failure to observe or perform any of our obligations under these Terms for any reason or cause which could not, with reasonable diligence, be controlled or prevented by us. These causes include acts of God, acts of nature, acts or omissions of governments or their agencies, pandemics, epidemics, strikes or other industrial action, fire, flood, storm, riots, power shortages or failures, sudden and unexpected system failure or disruption by war or sabotage, and other acts or omissions of third parties.
Applicable law
These Terms are to be construed and enforced in accordance with the laws in force in New South Wales, Australia. Any dispute arising from your receipt or use of a eGift Card is exclusively subject to the jurisdiction of the courts of New South Wales, Australia.
